Terms & Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Topic Companion (“we,” “us,” or “our”) and the individual purchasing the services (“Customer,” “you,” or “your”), typically the adult child or legal representative of the senior receiving the services (“Senior”).

By purchasing a subscription or booking a session, you agree to the following:

1. Scope of Service: Strictly Non-Medical

Topic Companion provides social and intellectual companionship only.

  • No Medical Care: Our Companions are not licensed medical professionals, nurses, therapists, or social workers.

  • No Clinical Advice: We do not provide medical diagnosis, treatment, medication administration, or physical assistance (e.g., help with walking or bathing).

  • Tele-Companionship: Services are conducted via phone or video call and are intended to provide emotional support and cognitive stimulation through conversation.

2. Emergency Protocol

While our service is social in nature, we prioritize the safety of the Senior.

  • In-Call Emergencies: If a Companion observes what they believe to be a medical emergency during a call, they will immediately contact 911 (Emergency Services) and then notify you at the contact information provided in your account.

  • Limitations: You acknowledge that Topic Companion is not an emergency monitoring service (like LifeAlert) and cannot guarantee a response in a life-threatening situation.

3. Privacy & Recording

  • No Recording: To ensure a safe and private space for the Senior, Topic Companion does not record calls.

  • Notes: Companions may take brief, written internal notes regarding "Spark Topics" or conversation interests to improve future sessions. These are stored securely and are not shared with third parties.

4. Fees and Subscriptions

  • The Payer is the User: By entering your payment information, you confirm you are at least 18 years of age and authorized to make this purchase.

  • Recurring Billing: Subscriptions (e.g., $169/month) are billed automatically every 30 days. You may cancel at any time through your Member Portal, but refunds for the current billing cycle are subject to our Refund Policy.

5. Termination of Service

We strive for a positive experience, but we reserve the right to terminate a session or a subscription immediately for the following "Safety & Respect" reasons:

  • Aggression: If a Senior becomes verbally abusive, aggressive, or uses highly inappropriate language toward a Companion.

  • Inappropriate Behavior: Any sexual harassment or exposure during video calls.

  • Mental Health Crisis: If a Senior’s cognitive state has declined to a point where they are in distress or require clinical intervention that exceeds the scope of social companionship.

  • Non-Payment: If a subscription fails to renew and remains unpaid.

6. Limitation of Liability

To the fullest extent permitted by the laws of the State of Georgia, Topic Companion shall not be liable for any health outcomes, physical injuries, or psychological changes occurring to the Senior. We provide social engagement, not a healthcare outcome guarantee.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles.
